FAQ Bankruptcy Le Plaza Basel-Stadt AG

On January 6, 2021 the operator of the Swissôtel Le Plaza Basel, Le Plaza Basel-Stadt AG, was declared bankrupt by the civil court of Basel-Stadt. The Basel-Stadt bankruptcy office is acting as official receiver for Le Plaza Basel-Stadt AG.

The Swissôtel Le Plaza Basel is closed.

Update of May 28, 2021

The call to the creditors has been closed. So far, claims in the amount of CHF 3,075,459.85 (of which CHF 707,427.70 in 1st class and CHF 66,314.20 in 2nd class) have been registered. The dividend prospects and the date on which the schedule of claims will be published are not yet known.

What does the bankruptcy of Le Plaza Basel-Stadt AG mean?

Bankruptcy proceedings have been initiated in accordance with Art. 725a OR, since the liabilites of Le Plaza Basel-Stadt AG exceeded the existing assets. All assets of Le Plaza Basel-Stadt AG are currently administered by the bankruptcy office.

What happens to bookings at Swissôtel Le Plaza Basel?

The Swissôtel Le Plaza Basel is closed until further notice. All bookings at the Swissôtel Le Plaza Basel are cancelled.

I have already paid for a room. Will I get an instant refund?

No. Payments made belong to the bankruptcy estate. Refunds constitute a bankruptcy claim which may be fulfilled only to the extent of the assets available. Such claims have to be filed by submitting (by letter) a "proof of claim" in the bankruptcy proceedings in order to be considered.

Can I change the existing booking to another hotel?

All bookings at the Swissôtel Le Plaza Basel are cancelled. To make a booking at another Accor hotel, contact CE.SALES.TEAM@accor.com.

How long will the bankruptcy proceedings take?

No prognosis can yet be given about the duration of the proceedings. The schedule of claims is not expected to be published before 2022.

As a creditor, will I be kept informed from time to time?

No. For cost reasons, the creditors will only be informed by letter when the law requires us to. However, general information on the proceedings will continue to be published on this website.

Can I expect my claim to be paid?

At the present time it is not possible to estimate the dividend. It should be noted, however, that customer claims according to Art. 219 (4) SchKG are not entitled to priority in the schedule of claims.
